Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Manifesta Inc. ("Manifesta," "we," "us," or "our") governing your access to and use of the Manifesta mobile and web application, website, and related services (collectively, the "Service").

By accessing or using the Service, you represent that you are at least 13 years of age and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Manifesta is a personal growth and manifestation platform that provides:

• AI-powered manifestation journaling and coaching
• Human Design and Gene Keys profile generation
• Daily check-in and streak tracking features
• Personalized manifestation guidance and reports
• Subscription-based access tiers (Luminary and Cosmic)

The Service is intended for personal development, self-reflection, and motivational purposes only. It is not a medical, therapeutic, or mental health service. See our Mental Health Disclaimer for more information.

3. User Accounts

3.1 Account Creation

You must create an account to access the Service. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Age Requirement

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

4. Subscription Plans and Payments

4.1 Subscription Tiers

The Service is offered under the following subscription plans:

• Luminary Plan: $27/month - includes 5 manifestation chat sessions, full Human Design profile, Gene Keys Hologenetic Profile, AI consciousness assessments, and personalized manifestation reports
• Cosmic Plan: $97/month - includes unlimited manifestation chats, everything in Luminary, priority AI responses, full profile and star map, channeled messages aligned to your design, and future group sessions and live features

4.2 Billing

Subscription fees are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

4.3 Refund Policy

All subscription fees are non-refundable except as required by applicable law or as expressly stated in these Terms. If you cancel your subscription, you will retain access to the Service until the end of your current billing period.

4.4 Price Changes

We reserve the right to modify subscription pricing with at least 30 days written notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4.5 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at legal@manifesta.app. Cancellation takes effect at the end of the current billing cycle.

5. User Content

5.1 Your Content

You retain ownership of all content you submit to the Service, including journal entries, manifestations, and profile information ("User Content").

5.2 License to Us

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving the Service.

5.3 Content Standards

You agree not to submit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable. We reserve the right to remove any content that violates these standards.

6. Artificial Intelligence Disclaimer

The Service uses AI technology, including large language models, to generate responses, insights, and recommendations. You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or inconsistencies
• AI responses are not professional advice of any kind
• AI-generated content should not be relied upon as a substitute for professional medical, psychological, financial, legal, or other professional advice
• We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content

7. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorized access to any portion of the Service
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use the Service to transmit spam, malware, or other harmful content
• Impersonate any person or entity or misrepresent your affiliation
• Use automated scripts or bots to access the Service
• Resell, sublicense, or commercially exploit the Service without our written consent

8. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of Manifesta Inc. or its licensors and are protected by applicable intellectual property laws.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MANIFESTA INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Manifesta Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Service or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Your continued use of the Service after such notification constitutes your acceptance of the updated Terms.
